I found the chapter in your book about this the best, most clear argument I've ever seen for expanding the court. Before I read it earlier this year I really didn't understand the idea or why it made sense. I've been recommending it to people this weekend whenever the topic comes up and now I'm cringing when I see Democrats call it "packing the court."
I set about to research the history of SCOTUS this morning in order to come to an informed opinion about court reform. Then I opened my email and received precisely the information I needed. Thank you again Dan for doing my homework. Still curious to learn more but I have a basic understanding.
I was definitely excited to see talk of expanding the court in this most recent primary; but though I was a Buttigieg supporter, I didn't like his plan, which I felt codified the already too-political nature of the court. What are your thoughts on making it "fair" (an obsession of the Democrats that really annoys the hell out of me) while still ensuring that each appointment to the newly expanded court doesn't become this kind of life-and-death showdown? Will term limits alone solve for that, or is there some other piece?
I agree with you. I love that Buttigieg was willing to run on court reform. It was a huge deal for the movement. I didn't love the plan he eventually put forward. Term limits has some complications, but there are some ways to do it that help mitigate some of the consitutional concerns. They should be part of a broader reform plan
