Frankly speaking, this should have been the message from word ‘go’. This is all Dems should have been talking about since Dobbs at the very least. It boggles the mind that the Biden campaign isn’t out in front on this. I can only hope that the Biden team takes this on board.

Biden unilaterally disarmed in his first speech to Congress by saying he would not seek to expand the court. Rather than making them toe the line by keeping that as an ambiguous threat.

Reverse that by running hard on their bad behavior. They can’t really fight back in the moment, so go hard. Be ambiguous about expanding the court to intrigue those voters who want that. Harp on Alito and Thomas’s ages. Hang charges of bribery and faithlessness to impartiality on those two. Talk about the lies that Barrett and Kavanaugh told in their hearings.

I like that vision of a Dem majority in the house and the senate, and a reworking of the Court. I also like your thinking about pushing ethics and rules as part of the process of getting there. If the Court knows what is right, they would work with Congress to develop a more ethical process moving forward. Alito is endemic of a long-standing problem with entitled men feeling they are above reproach, and willingly throwing their wives under the bus. Mrs. Alito sounds a bit thin-skinned for someone married to a public servant.

Love the idea. People smarter than I need to figure out how to execute it. Given that some

in America think the Dems are responsible for ending abortion access, and even more (dare I say, “most?” Someone check Pew.) Americans can’t name a single USSC justice…how to make the connection between USSC and the life of an average person? Ffs, I wish people cared how government functions and how it affects our lives. 😩

Dan why do you keep referring to The NY Times/Sienna poll? Everything I read about that poll makes a clear outlier. I appreciate your point re: the Supreme Court but please stop legitimizing that poll.

No one poll means anything particularly six months before an election! I respectfully propose that his overall argument should certainly call for a Code of Ethics but running exclusively on revisions to the Court is not productive.

Couple of thoughts:

1. We need simple clear messaging if this is going to work

2. It needs to be tied directly to the lives, bodies, and pocketbooks of voters to give it the emotional impact needed to drive action (like Deepak Puri’s link above)

I agree 100 on the concept. As you know, But national polls do not win presidential elections. To make this case you need to be showing what the polls say in the key swing states on this issue in PA, WI, MI, GA, AZ, NV.

HCR made a point yesterday:

Alito "blamed his wife ... for flying the flag, saying she had hung it up in response to a 'F*** Trump' sign that was 'within 50 feet of where children await the school bus in Jan[uary] 21.'"

However,

"the local schools were all remote in January 2021 because of the pandemic. 'No children were waiting for buses.'"

I agree the Supreme Court is also on the ballot this year. I cringe at the thought at Trump appointing two judges like Alito and Thomas.

My god, as long as I have been active with the Dems it has all, always and always, been about The Supreme Court. Also, if no one else wants to, y'all can appoint me. Tony would vote for me. I am not a lawyer I am a professional philosopher, therapist, artist. I think it could work.
